PRIVACY POLICY AND PERSONAL DATA PROTECTION  

INTRODUCTION  

With this privacy and personal data protection policy, VOUGAMOLDES, LDA. a limited liability  company, registered at the Commercial Registry Office under the registration and VAT  number 502.312.726, with a share capital of 24,940.00 with its head office at Lugar da Vista  Alegre, lote n.º 3, 3850, Albergaria-a-Velha, hereinafter referred to as “VOUGAMOLDES LDA. “,  aims to inform Clients/Users of VOUGAMOLDES LDA.’s policies and procedures regarding the  collection, utilization, processing and disclosure of any personal data transmitted directly by  its Clients/Users or through third parties by using the website operated by VOUGAMOLDES  LDA. – www.vougamoldes.pt .  

VOUGAMOLDES LDA. respects the privacy of its Clients/Users, and is committed to  protecting the information it collects from them, as well as complying with the legal rules in  force defined by the General Data Protection Regulation (RGPD).  

Access to and use of the website, as well as subscription of the services and products it  provides, imply the agreement, acceptance and binding of users to this privacy and data  protection policy.  

1. WHO ARE WE?  

VOUGAMOLDES LDA. is a Commercial Company operating in the manufacturing of molds. 

VOUGAMOLDES LDA. is dedicated to protecting the personal data of our clients/users of  products and services, as well as the personal data of their owners in all situations where  personal data is processed.  

2. NEED FOR THIS POLICY  

Through this policy, it is intended to inform Clients/Users of the general rules for processing  personal data, which are collected and processed in strict respect and compliance with the  legislation on the protection of personal data in force at any given time, namely Regulation  (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“RGPD”) as well  as other legislation on this matter that is applicable or comes into force, especially Law No.  58/2019, 8th August. 

VOUGAMOLDES LDA. is dedicated to the protection and confidentiality of personal data and  has adopted the measures it deems appropriate to ensure the accuracy, integrity and  confidentiality of personal data, as well as all the other rights of the holders of such personal  data.

VOUGAMOLDES LDA. honors the best practices in the areas of security and protection of  personal data, and has adopted the technical and organizational measures necessary to  comply with the RGPD and to ensure that the processing of personal data is done lawfully,  fairly, transparently and limited to the purposes authorized under the RGPD and other  applicable legislation. 

This Privacy and Data Protection Policy is also intended to supplement the provisions on the  protection and processing of personal data set out in the contracts that Clients/Users have  entered or will enter into with VOUGAMOLDESLDA., as well as the rules provided for in the  terms and conditions governing the various services offered and which are duly advertised  on our website. 

3. PERSONAL DATA SECURITY MEASURES  

VOUGAMOLDES LDA. has always been concerned about the protection and security of the  personal data provided to us. To this end, VOUGAMOLDESLDA. has implemented an internal  security policy and compliance with these rules is an obligation of all those who legally access  them, including its employees. These rules and security measures are of a technical and  organizational nature and aim to protect personal data against disclosure, loss, improper  use, alteration, unauthorized processing or access, as well as against any other form of  unlawful processing. 

Additionally, third parties who, in the course of providing services, process the personal data  of the Client/User on behalf of VOUGAMOLDES LDA, are required, in writing, to implement  appropriate technical and security measures that, at all times, meet the requirements of  the RGPD and other applicable legislation and aim to safeguard the rights of the data  subject. 

As part of our internal security policy, all forms of online collection of personal data are  encrypted and stored securely, and physical and logistical security measures have been  implemented. 

However, VOUGAMOLDES LDA. does not dispense the adoption of security measures by  Clients/Users, especially with regard to the use of online personal defense systems (firewall,  antivirus, anti-spyware, tools to verify the suitability of websites, etc.). 

4. WHAT IS PERSONAL DATA?  

For the purposes of Article 4(1) of the RGPD, “Personal data means information relating to an  identified or identifiable natural person (“data subject”); an identifiable natural person is one 

who can be identified, directly or indirectly, in particular by reference to an identifier, such as  a name, an identification number, location data, electronic identifiers or to one or more  factors specific to the physical, physiological, genetic, mental, economic, cultural or social  identity of that natural person.” 

  

5. PROCESSING OF PERSONAL DATA  

For the purposes of Article 4(2) of the RGPD, “”Processing” shall mean an operation or set of  operations which is performed upon personal data or a collection of personal data, by  automated or non-automated means, such as collection, recording, organisation,  structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by  transmission, dissemination or otherwise making available, alignment or combination,  restriction, erasure or destruction.” 

  

6. WHO IS THE DATA CONTROLLER?  

VOUGAMOLDES LDA. is the controller of personal data according to the purposes and means  of processing them at any given time.

7. IS THERE A DATA PROTECTION OFFICER?  

VOUGAMOLDES LDA. has appointed a Data Protection Officer.

8. TYPES OF PERSONAL DATA THAT MAY BE PROCESSED  

Considering the activities performed by VOUGAMOLDES LDA., we process personal data  necessary for the provision of services, supply of goods or in our social responsibility  activities, processing personal data such as name, address, telephone number, email  address, citizen card number or tax payer number. The information collected may be greater  or lesser depending on the information provided by the Client/User. On the other hand,  VOUGAMOLDES LDA. processes data relating to insurance and health data.

Except when required to do so by law, all data shall be processed exclusively by  VOUGAMOLDES LDA. only to the extent necessary to develop its business, and also to allow  the Client/User to have access, for example, to specific features of the services,  suggestions and informative services in proximity. 

The personal data, traffic, geographical location, profile and/or consumption data may be  processed by VOUGAMOLDES LDA. for the purposes of advertising or publicising offers of  goods or services provided by VOUGAMOLDES, LDA., that the holder of the personal data has  authorised/consented to this. 

If there is prior consent from the CLient/User, this may be withdrawn at any time, without,  however, the lawfulness of the processing carried out on the basis of prior consent being  invalid. For the withdrawal of consent, you may use the email address:  resp.rgpd@vougamoldes.pt. 

  

9. CIRCUMSTANCES OF PROCESSING BY SUBCONTRACTORS  

In our business activities, VOUGAMOLDES LDA. uses third parties to provide certain types of  services which may involve access, by these entities, to personal data of Clients / Users.  When this happens, VOUGAMOLDES LDA. ensures that the subcontractors comply with the  RGPD and other applicable legislation, as well as with certain rules that are similar to our  internal security policy.  

In case of communication of personal data to other subcontractors, VOUGAMOLDES LDA.  remains responsible for such personal data.  

  

10. DESTINATION OF PERSONAL DATA  

Personal data is intended for use only by VOUGAMOLDES LDA. or its group companies, and  may only be used by third parties to fulfil legal obligations. 

  

11. COLLECTION OF PERSONAL DATA  

VOUGAMOLDES LDA. only collects personal data by telephone, by email, by contract, through  its website and always ensuring the prior consent of the owners of the personal data.  

Please note that some personal data is essential for the performance of contracts entered  into and, if missing or insufficient, it may compromise the performance of services or the  supply of goods by VOUGAMOLDES LDA. 

To those personal data subjects who are not VOUGAMOLDES LDA. clients/users, the rules of  this policy apply. 

The personal data collected may be processed by computer and in automated or non automated form. VOUGAMOLDES LDA. ensures compliance with RGPD and other applicable  legislation. The personal data is stored in specific databases created for this purpose.  Personal data will never be used for any purpose other than that for which it was collected  or for which consent was given by the data subject. 

  

12. PURPOSES  

In general, the personal data collected is based on and intended for the management of the  contractual relationship, the provision of the contracted services, the adequacy of the  services to the needs and interests of the Client/User, actions of information and  advertising. 

As already mentioned, personal data may also be processed for the purpose of complying  with legal obligations. 

If the Client/User gives his consent, VOUGAMOLDES LDA. may use the personal data provided  by the data subject for other purposes, such as social responsibility, sending complaints and  suggestions, to inform of campaigns, promotions, advertising and news about  VOUGAMOLDES LDA. products and/or services, as well as for market research or evaluation  surveys.  

  

13. CONSERVATION OF PERSONAL DATA  

The conservation and storage of personal data is necessarily related to the purpose for  which the information was collected and is processed.  

Except in cases where there may be a legal obligation to keep personal data, such personal  data will only be stored and kept for the minimum period necessary for the purpose for  which they were collected.  

14. TRANSFER OF PERSONAL DATA  

VOUGAMOLDES LDA. does not transfer personal data, and if it should occur, it will do so in  accordance with the RGPD and other applicable legislation. This, however, does not affect the  exercise of the right to portability by the holder of personal data.  

 

15. YOUR RIGHTS AND HOW TO EXERCISE THEM  

As the owner of personal data, VOUGAMOLDES LDA. guarantees you, at any time, the right to  access, rectify, update, limit and delete your personal data (except for data that are  indispensable to the provision of services or the supply of goods where the contractual  relationship still exists), the right to oppose the use of such data for commercial purposes  by VOUGAMOLDES LDA. and to withdraw consent, as well as the right to data portability. All  rights under the law that the holder of personal data may exercise are provided by  VOUGAMOLDESLDA.
